TS Japan Rail Travel

TS Japan Railway Travel Planning Company Limited

(Japanese name: TS日本鉄道旅行企画株式会社)

hereafter “TS Japan Rail” conducts business on the following terms & Conditions;

1. Scope of services offered

TS Japan Rail is a travel planning and consultancy company and its services are limited to providing clients with travel ideas and suggestions for travel in Japan, travel planning services, travel consultancy relating to rail travel in Japan and associated services.
TS Japan Rail is not a travel agent so cannot arrange bookings and other services normally provided by travel agents. We can however assist clients or travel agents to make their own booking and we can also introduce clients to travel agents we work with to complete their bookings if required.

Payment of the agreed fee, in full, is required before TS Japan Rail will start work on a client’s assignment.
Fees should be paid by credit card, bank transfer or other means agreed between TS Japan Rail and the client. In the case of bank transfers the client is responsive to pay both payer and payee fees. For credit card and other electronic payments TS Japan Rail will bear the merchant costs.
As TS Japan Rail provides customized services to clients, the actual fee may differ from that advertised on our website or other places, but TS Japan Rail will agree with the client on the final fee prior to work starting.
TS Japan Rail reserves the right to charge for any out of pocket expenses it incurs in order to provide the agreed service to the client that have not been included in the agreed fee or scope of services. We will however endeavour to give the client prior notice before the fee in incurred.

TS Japan Rail will not refund fees paid unless it is proved that TS Japan Rail has been grossly negligent and not provided the agreed service.
For avoidance of doubt, TS Japan Rail will not refund fees paid in cases where:

1. 1. The client decides not to travel to Japan for whatever reason.
  2. The client cannot travel to Japan for any reason.
  3. The client decides not to follow some or all of our suggestions or travel itineraries.
  4. Weather, natural disasters etc. mean that our suggestions, ideas or travel itineraries cannot be carried out.

TS Japan Rail values the fact that it is independent and that the advice we provide is based on our own knowledge and experience and / or has been evaluated by us. TS Japan Rail, however, may in some circumstances receive commissions from other service providers when we refer the client to them. We will make the client aware when this is the case and explain why we are using this provider.

TS Japan Rail takes a lot of care and effort to ensure that information provided to clients is correct and accurate. In the event that we have made any material errors or omissions the limit of any compensation payable is the fee that was paid to TS Japan Rail. TS Japan Rail will not compensate for any other losses, additional costs etc that the client incurs.
TS Japan Rail will not be responsible or pay any compensation where any train or other transportation service we list in our itineraries, travel suggestions and ideas etc, does not run or runs at a different time where schedules have been changed subsequent to the delivery of our advice or travel itineraries or such changes had not been published by the service operator.

TS Japan will only share personal and confidential information with contractors that work with us and who have satisfied us that they have strong Privacy policies and procedures in place and it is necessary for them to see this information for us to provide our services to you or for us to comply with legal and regulatory obligations.
TS Japan Rail does not provide or sell personal or other confidential information relating to our clients to any third party, other than in the above case, without the clients’ approval.

TS Japan Rail will always endeavor to resolve disputes with clients in a mutually acceptable way.
The laws governing these terms of business shall be the laws of Japan, and the Tokyo District Court shall be the exclusive jurisdiction of the first instance for all disputes relating to these terms.
